OKANOGAN-WENATCHEE NATIONAL FOREST
Indian Creek Emergency Road and Trail Closures
Pursuant to 16 USC 551 and 36 CFR 261.50(a) and (b), and to protect natural resources and provide for public safety, the following acts are prohibited with the Naches Ranger District of the Okanogan-Wenatchee National Forest:
1. Being on National Forest System Road [NFSR] 1308 north of where it intersects with the southern boundary of Section 31, T.13N. R.13E. (see attached map) and where a physical road closure barricade/posting has been established [36 CFR 261.54 (e)].
2. Being on Indian Creek Trail #1105 from its trailhead in Section 26, T.13N. R.12E. north to its intersection with Trail #1109 [36 CFR 261.55(a)].
This restriction is effective the date signed below and will remain in effect until rescinded.
Pursuant to Title 36 CFR 261.50(e), the following persons are exempt from this order:
1. Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.
2. Any Federal, State or local officer, or member of an organized rescue or firefighting force, in the performance of an official duty.

Violations of these prohibitions are punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than 6 months or both. (16 USC 551 and 18 USC 3559 and 3571).
Assessment of Need and Enforcement Plan 1. Background – Road segments and trails included in this order were heavily damaged by a mud slide event on September 5-6 and are being closed to provide for public health and safety. 2. Intent of Subpart B Order – The intent of the order is to eliminate public vehicle travel on roads and trails damaged by mud slides. The intent of the order is to provide for public health and safety. The order shall remain in effect until no longer needed. The affected area includes portions of National Forest System Road 1308 and Indian Creek Trail #1105. 3. Enforcement Plan – Public notification shall include press releases, web site posts and on-site posting. Guard(s) and/or physical barriers will be provided on site as needed for education and enforcement.
