Unhappy Planning Decision-Appeal Status Update

Louise just brought over the certified letter from the Appeal Officer in the Regional Foresters office in Portland. He has upheld the Responsible Official on all points raised on both my appeal and that of Deschutes County 4 Wheelers. In short we got nothing out of it other than a couple of routes added in the first decision. It will now be up to the Region and the Association if they wish to pursue the issues any further. Any more action will now be via the court system, as this is the end of the administrative side of things.

Sorry to hear that. I thought ya'll had done a great job of trying to get your points across in your appeals. What time frame are we looking at if it needs to be filed in court?

Not that familiar with that end, but I think normal procedure is that you have to give the feds 60 days notice that you are going to file suit.

Talked to the FS a couple of days ago, and they are hoping to put boots on the ground to see about routing on a couple of new trails in the plan sometime in the next 45-60 days. Will keep everyone posted with what happens. Supposedly the FS guy in charge is a class III user.

Give them the 60 day notice that you plan to file suit. This will overlap what's happening now and may change their point of view!!!
